Determining child custody payments
Arizona courts take a number of factors into account as they determine the amount to be paid in child support, including the following:
- Gross income of both parents (including what should be earned)
- Spousal maintenance paid or received
- Medical insurance costs for the child, including dental and vision care
- Childcare costs
- Amount of parenting time per year
An experienced attorney helps ensure that accurate information is given to a judge deciding child support payments as part of a divorce or in a hearing for support modification.
Spousal support
There are two main phases to determining spousal support.
- Is the person entitled to spousal maintenance?
- If yes, how much? For how long? Is the amount modifiable?
If a judge has to decide an alimony case, he or she will make the spousal support modifiable. Therefore, many people want to settle their case in order for it to be non-modifiable. Negotiation requires skill to obtain a favorable outcome and gain certainty. The goal of the family lawyer is to prepare for and to provide certainty. Most clients want to avoid the cost and the risk of going to trial. I strive for well thought out and planned settlements.
